These Terms of Service (“Terms”) govern your use of monkeyfresh.ca and purchases from EIVYS CANADA LTD (“EIVYS Canada,” “we,” “us,” or “our”). By accessing the website or placing an order, you agree to these Terms. If you do not agree, do not use the website.

1. Eligibility and account information

Prices are shown in Canadian dollars unless stated otherwise. Applicable taxes and shipping charges are calculated at checkout. We may correct pricing or description errors before fulfilment. If a correction materially changes an accepted order, we will contact you or cancel and refund the affected amount.

Your checkout submission is an offer to purchase. An order is accepted when we confirm acceptance or dispatch the goods. We may suspend access for prohibited conduct.

The website and its original content, branding, graphics, text, layout, and software are owned by or licensed to EIVYS Canada and are protected by applicable intellectual property laws. You may use the website only for personal, non-commercial shopping unless we give written permission.

8. Reviews and submitted content

If you submit a review, image, suggestion, or other content, you confirm that you have the right to do so and that it is lawful and accurate. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, and display that content in connection with our business, subject to our Privacy Policy. These Terms do not limit rights or remedies available under applicable Canadian federal, provincial, or territorial consumer protection law. If there is a conflict, mandatory law prevails.

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without limiting mandatory consumer protections in your province or territory. Subject to those protections, disputes will be brought before the courts of Ontario.

16. Changes and severability

We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless law permits otherwise. If any provision is unenforceable, the remaining provisions continue in effect.

17. Entire agreement and contact

These Terms and the policies referenced above form the entire agreement between you and EIVYS Canada regarding the website and purchases, except for rights that cannot be excluded by law.
